This Privacy Policy (“Privacy Policy”) describes how Kind Innovations Inc., operating under the name Workind (“Workind,” “we,” “our” or “us”), collects, uses, protects and discloses the personal information of visitors to its website https://www.workind.ca and any related subdomains (collectively, the “Website”).

We are committed to safeguarding your privacy and protecting the information that we collect about you. This Privacy Policy details how we will use the personal information that we collect:

a) when you use our Website, receive our emails or use our application (collectively, the “Services”),

b) when you purchase products and services through our application (the “Products”),

c) through other ways, as described in this Privacy Policy.

By using our Services or purchasing our Products, you acknowledge that we collect, process and disclose your personal information in accordance with this Privacy Policy.

 

1. Collection of Personal Information

We collect information about you in a few different ways:

1.1. Information you provide directly through:

a) Online accounts. To access our application, you must first create an online account and provide us with some personal information. Such information may include, but is not limited to, your first and last name, email address, phone number, date of birth, gender and home address.

b) Additional information requests. To purchase certain Products, we may ask for additional personal information necessary to process and secure your order. This may include, but is not limited to, delivery address, identity verification details and any other information reasonably required to complete your purchase.

c) Online payments. To complete purchases on our Website, we may collect your name, email address, delivery details, phone number, credit card number, expiration date, security code (CVV) and billing address (if different from your home address) (collectively, “Billing Information”). Billing Information will be used solely to process your credit card transaction. For more details on how we process your Billing Information, please see Section 6 below.

d) Your communications with us. When you contact us by email, live chat through our customer support platform or any other means, we collect details of those communications to respond to your inquiries and service requests. We rely on third-party providers such as Zendesk to host our live chat and customer support

1.2. Information collected automatically through:

a) Connection data. We automatically collect certain information about your use of our Services (“Connection data”), including IP address, device type, browser, operating system, pages visited, features used, frequency of use, terms searched, links clicked, time spent, time zone and approximate location. We use connection data to improve and personalize our Services and Products.

b) Cookies and similar technologies. If you have given your consent (in accordance with applicable laws), we may use cookies or similar technologies to analyze trends, manage website pages, track website browsing, and collect general demographic information. You can control your local cookie preferences in their web browser settings.

1.3. Other sources

We may collect information from other sources, including data analytics companies, public databases, publicly available social media profiles, and other third-party partners, such as Google.

2. Use of personal information

We use the personal information we have collected for various purposes:

2.1. Delivery of products and services. We can use your personal information to provide our Services, process and fulfill your Product orders, and notify you of policy changes. We use the personal information we collect to perform our contract obligations towards you or comply with our legal obligations.

2.2. Marketing communications. We can use your personal information to send you promotional emails about Products, Services, contests and special offers.

2.3. Research and development. We can use your personal information to analyze customer preferences, produce trend reports, improve Products and Services, and customize your experience. We may create aggregated data using anonymized information. To do so, we remove identifiers to ensure that you cannot be identified.

2.4. Compliance and protection. We can use your personal information to:

a) comply with applicable laws, legal proceedings and government-mandated authorities

b) protect our rights, privacy, safety and property, and those of third parties

c) ensure that our internal practices comply with legal, contractual and policy requirements; and

We may share and disclose your personal information with the following parties, as described in this Privacy Policy or as disclosed at the time of collection of that personal information.

 

3.1. Law enforcement and other authorities, including governmental and private entities, if we believe in good faith that it is necessary to do so to enforce Section 2.4.

3.2. Corporate transactions. We may share information with potential or actual buyers or merger partners in connection with the sale, merger, financing, reorganization, acquisition or insolvency of all or part of our business or assets.

3.3. Professional advisors and service providers. We may share information with employees, contractors, and third-party service providers (e.g., lawyers, accountants, auditors, insurers) who require access to perform or manage services for us.

4. Data retention

4.1. Purpose of retention. We retain the personal information we collect for as long as necessary and relevant to fulfill the purposes outlined in this Privacy Policy. In addition, we retain personal information to comply with applicable laws, prevent fraud, resolve disputes, troubleshoot issues, support any investigations, and carry out any other actions permitted by law. To determine the appropriate retention period for personal information, we consider the amount, nature, and sensitivity of the personal information, the risk of harm from unauthorized use or disclosure of your personal information, the purposes for which we process your personal information and whether those purposes can be achieved through other means, as well as applicable legal requirements.

4.2. Anonymization. We may irreversibly anonymize personal information (so it can no longer be linked to you) and retain it indefinitely for internal purposes.

4.3. Security measures. We use standard security measures designed to protect the security of all information submitted through the Services. However, the security of information transmitted over the internet can never be guaranteed. We are not responsible for any interception, interruption, alteration, or loss of data during internet transmission. You are responsible for maintaining the security of any password, user ID, or other form of authentication used to access password-protected or secure areas of any of our Services. In the event of a suspected security breach and to protect you and your information, we may suspend your use of any of the Services, without notice, while an investigation is conducted.

5. Your rights

Subject to applicable laws, you have the following rights with regards to your personal information:

5.1. The right to access the personal information we have processed about you.

5.2. The right to request that we transfer your personal information directly to you or to another entity, including in a structured, commonly used, and machine-readable format. This may apply to personal information that we process by automated means and with your consent or based on a contract with you. We will transfer your personal information when technically feasible.

5.3. The right to have your personal information erased if we no longer need it for its original purpose, if you object to our processing of your personal information for our legitimate interests or for personalized marketing messages, if you withdraw your consent to the processing of your personal information, if we are processing your personal information unlawfully, or if we are legally required to delete your personal information.

5.4. The right to object to the use of your personal information for our own legitimate interests. We will review your objection and determine whether the processing of your personal information has an overriding impact on you that requires us to stop processing it. You may not object to the processing of your personal information if we are legally required to process it (for example, if we are obligated to fulfill a contract with you).

5.5. The right to request a correction to your personal information if inaccurate. If the information we have about you has been shared with a third party in accordance with this Privacy Policy, we are obligated to notify the third party of the correction.

5.6. The right to request that we limit our use of your personal information if you believe it to be inaccurate, if we are processing the information unlawfully, or if you have objected to our processing of your personal information for our own legitimate interests.

5.7. The right to file a complaint using the contact details provided in Section 10 of this Privacy Policy if you are not satisfied with how we have addressed your concerns. If you remain dissatisfied with our response, you may also contact your country’s privacy commissioner.

Please note that deleting your personal information may prevent you from using our Services.

6. Third-party payment processors

Workind partners with third parties, such as Stripe, to collect information and process secure payments for Product orders and purchases made through the Website. No Billing Information is stored on servers controlled by Workind. Stripe is authorized to store, on behalf of Workind, transaction-related information (including all Billing Information) to ensure a secure payment method, archive proof of purchase, provide customer protection, and enable follow-up when needed. This information may be used for customer validation and registration purposes, and to trace any fraudulent activity if necessary. When you make a purchase on our Website, you are subject to Stripe’s privacy policy, which we encourage you to review on their website.

7. Limitation of liability

We, and/or our officers, directors, shareholders, owners, officials, partners, associates, managers, employees, affiliates and other related entities, representatives, agents, successors, and assignees, shall not be held liable for any losses or damages (financial or otherwise) resulting from the misuse of any information collected through the Services, provided such misuse does not constitute a violation of this Privacy Policy or any applicable law.

8. Compliance with privacy laws

This Privacy Policy and our overall practices are designed to comply with the Personal Information Protection and Electronic Documents Act (Canada) (S.C. 2000, c. 5) and the Act Respecting the protection of personal information in the private sector (Quebec) (CQLR c. P-39.1).

 

9. Changes to this privacy policy

We may update this Privacy Policy at any time. We encourage you to review this page regularly to stay informed about our current privacy practices. If we make changes, we will update the “Last Updated” date above. Any changes to this Privacy Policy will take effect upon the posting of the new terms and/or the implementation of the changes to the Services (or as otherwise indicated at the time of posting). In all cases, continuing to use the Services after a modified Privacy Policy has been posted means that you accept the terms of the updated policy.
